Ronald L. Holt

Ronald Holt brings 31 years of experience in a broad range of commercial and general litigation matters in various industries regionally and across the country. He has a national practice representing institutions of higher learning in litigation, regulatory matters and business transactions.

Ron served a two-year clerkship with the late United States District Judge Russell G. Clark before entering private practice. He has served as lead counsel and successfully prosecuted and defended substantial claims in commercial, banking, antitrust, securities, environmental, employment, insurance and higher education litigation matters, including complex commercial cases.

Active in representing for-profit postsecondary institutions around the nation, Ron is a member of the Association of Private Sector Colleges and Universities headquartered in Washington, D.C., where he serves on its Legislative Advisory Council.

Representative Engagements

Higher Education

  • On behalf of ConCorde Career Colleges, Inc., obtained an injunction against the Secretary of Education of the U.S. Department of Education related to the unacceptable servicing of student loans, which allowed ConCorde to continue to participate in the Federal Student Loan and Grant Programs.
  • In a complex matter related to whether or not the institution should be governed by the 90/10 Rule, won an injunction on behalf of Mission Group Kansas, Inc. After the case went up on appeal, it was remanded for further consideration by the trial court and the parties reached a settlement favorable to the school.
  • Obtained a declaratory judgment in favor of our NYC based client Calise Beauty School, Inc., against the Secretary of Education concerning loan servicing records that the Secretary had failed to require the State of NY to provide to NY schools when they challenged excessive loan default rates. The successful judgment mandated the Secretary to require the State to provide NY schools with all original and underlying records related to loan servicing for schools.

Commercial Litigation

  • Previously represented a large national bank in multi-million dollar litigation brought by the Kansas Public Employees Retirement System (KPERS) and negotiated settlement favorable to the bank
  • Represented a class of TWA Mechanics in an action against TWA and Chase Manhattan Bank to recover 401 K funds lost due to delay in the trading of a falling mutual fund, in resulting in a settlement approaching two million dollars.
  • Successfully defended sellers of a trade school against arbitration claims brought by the buyer seeking to recover nearly half the purchase price, with a resulting fee award made to the sellers.

Commercial Transactions

  • Served as regulatory counsel for the 2007 merger of the Empire Beauty School Group and the Regis Beauty School group, resulting in a combined company with nearly 90 beauty school campuses
  • Represented both buyers and sellers over an eight year time period in many transactions across the county for the sale or purchase of institutions with transaction values ranging from $250,000 to 40 million

Appellate Practice

  • Handled appeal to the 5th circuit of a case brought in Mississippi by a commercial manufacturer of pipe against its supplier for failure to deliver promised supplies.
  • Won an appeal for distiller Brown Forman against a former distributor of its products, who alleged that it had rights under state law to continue to handle the distiller's products.

Employment Litigation

  • Successfully negotiated favorable resolution of a case of sexual harassment brought by a woman against her supervisor in a garment production company.


  • From time to time perform various pro bono cases, including appointment to a federal criminal case involving a stolen load of pork that was tried to a hung jury and later resolved by a plea agreement.
